RIGHT OF WITHDRAWAL

1. Consumer Right of Withdrawal
If you are a Consumer, you have the right to withdraw from your purchase without giving any reason and without penalty within 14 calendar days.
For sales contracts, the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, physically take possession of the products.
If an order consists of several products delivered separately, the withdrawal period begins on the day on which you physically receive the last product.
2. How to Exercise the Right of Withdrawal
To exercise your right of withdrawal, you must communicate your decision clearly and unambiguously.

You may use the model withdrawal form included at the end of this document, although its use is not mandatory.
The withdrawal deadline is met if the notice is sent before the expiry of the 14-day period.
3. Return of Products
After notifying the Seller of your withdrawal, the products must be returned without undue delay and, in any event, within 14 days from the date on which you communicated your decision to withdraw.
The deadline is met if the products are returned before the 14-day period expires.

The direct cost of returning the products is borne by the Consumer, unless the Seller has expressly agreed to bear such cost.
4. Condition of Returned Products
The Consumer is liable only for any diminished value of the products resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the products.
Opening the packaging or handling the product to the extent reasonably necessary to inspect and test it does not automatically invalidate the right of withdrawal.
5. Refund
Following a valid withdrawal, the Seller shall refund all payments received from the Consumer, including, where applicable, the cost of standard delivery.
The refund shall be made without undue delay and in any event within 14 days from the day on which the Seller is informed of the Consumer's decision to withdraw.
The Seller may withhold the refund until the products have been received or until the Consumer has provided evidence that the products have been returned, whichever occurs first.
The refund shall normally be made using the same payment method used for the original transaction, unless otherwise agreed.
If the Consumer expressly chose a delivery method other than the least expensive standard delivery offered by the Seller, any additional cost shall not be refunded.
6. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the cases expressly provided for by applicable law.
In particular, the right of withdrawal may be excluded for products made to the Consumer's specifications or clearly personalised, where the relevant statutory exception applies.
If a specific product is subject to an exception to the right of withdrawal, this will be stated clearly on the relevant product page or during the purchasing process.
7. B2B Purchases
The statutory Consumer right of withdrawal applies only to Consumers.
It therefore does not apply to purchases made by businesses, professionals or other entities acting in connection with their business or professional activity, unless otherwise agreed in writing.

DIRITTO DI RECESSO

1. Diritto di recesso
Se sei un Consumatore, hai il diritto di recedere dal contratto di acquisto senza dover fornire alcuna motivazione e senza penalità, entro 14 giorni di calendario.
Il diritto di recesso è previsto dagli articoli 52 e seguenti del Codice del Consumo, salvo le eccezioni previste dalla legge.
Per i contratti di vendita, il termine di 14 giorni decorre dal giorno in cui tu, o un terzo da te designato diverso dal vettore, acquisisci il possesso fisico dei prodotti.
Nel caso di un ordine composto da più prodotti consegnati separatamente, il termine decorre dal giorno in cui acquisisci il possesso fisico dell'ultimo prodotto.
2. Come esercitare il diritto di recesso
Per esercitare il diritto di recesso è sufficiente inviare una comunicazione esplicita della propria decisione di recedere dal contratto.

Il termine di 14 giorni è rispettato se la comunicazione viene inviata prima della scadenza del periodo di recesso.
3. Restituzione dei prodotti
Dopo aver comunicato il recesso, i prodotti devono essere restituiti senza indebito ritardo e comunque entro 14 giorni dalla data in cui è stata comunicata la decisione di recedere.
Il termine è rispettato se i prodotti vengono rispediti prima della scadenza dei 14 giorni.

Il costo diretto della restituzione dei prodotti è a carico del Consumatore, salvo che il Venditore abbia espressamente dichiarato di sostenerlo.
4. Condizioni dei prodotti restituiti
Il Consumatore è responsabile esclusivamente della diminuzione del valore dei prodotti risultante da una manipolazione diversa da quella necessaria per stabilirne la natura, le caratteristiche e il funzionamento.
È pertanto possibile aprire la confezione e maneggiare il prodotto nella misura ragionevolmente necessaria per valutarne le caratteristiche e il funzionamento.
Il semplice danneggiamento o apertura della confezione non determina automaticamente la perdita del diritto di recesso.
5. Rimborso
In caso di valido esercizio del diritto di recesso, il Venditore rimborserà tutti i pagamenti ricevuti dal Consumatore, compresi, ove applicabile, i costi della consegna standard.
Il rimborso sarà effettuato senza indebito ritardo e comunque entro 14 giorni dal giorno in cui il Venditore è stato informato della decisione del Consumatore di recedere.
Il Venditore può tuttavia trattenere il rimborso fino alla ricezione dei prodotti oppure fino a quando il Consumatore non abbia dimostrato di averli rispediti, se precedente.
Il rimborso sarà effettuato utilizzando lo stesso metodo di pagamento utilizzato per la transazione iniziale, salvo diverso accordo.
Se il Consumatore ha scelto una modalità di consegna diversa dalla modalità standard meno costosa offerta dal Venditore, gli eventuali costi aggiuntivi non saranno rimborsati.
6. Eccezioni al diritto di recesso
Il diritto di recesso non si applica nei casi espressamente previsti dall'articolo 59 del Codice del Consumo.
In particolare, può essere escluso per:
- prodotti realizzati su misura o chiaramente personalizzati sulla base delle specifiche richieste del Cliente;
- prodotti realizzati secondo specifiche tecniche individuali richieste dal Cliente, quando rientranti nelle eccezioni previste dalla legge;
- gli altri casi espressamente previsti dalla normativa applicabile.
Qualora un prodotto sia soggetto a un'eccezione al diritto di recesso, tale circostanza sarà indicata preventivamente nella relativa pagina del prodotto o durante la procedura di acquisto.
7. Acquisti B2B
Il diritto di recesso previsto dal Codice del Consumo è riconosciuto esclusivamente ai Consumatori.
Pertanto, non si applica agli acquisti effettuati da professionisti, aziende o altri soggetti che acquistano nell'ambito della propria attività professionale o imprenditoriale, salvo diverso accordo scritto.
